Azerbaijan's E-Commerce Statutes: Contributing to Economic Growth and Globalization in the Caucasus Region

The government of Azerbajian is committed to the devel-
opment of information technology and e-commerce over the
next ten years and has enacted three e-commerce statutes
in 2003: the Electronic Document Law (EDL), the Elec-
tronic Signature Law (ESL) and the Electronic Trade Law
(ETL). The EDL declares that electronic documents can be
used in all activity spheres  so long as the technology and
expertise are available; this calls for perhaps the broadest
utilization of electronic documents the author has seen.
The ESL is primarily concerned with the regulation of Cer-
tification Authorities (CAs) that verify the authenticity and
integrity of electronic signatures and the electronic docu-
ments to which these signatures are attached. The ETL fo-
cuses on rules regarding the creation and execution of e-
commerce contracts. While together the laws establish a
good basic framework for the attainment of secure e-
commerce transactions in Azerbaijan, this author believes
that the laws can be improved with further additions or
amendments that address expanded consumer protections,
a computer crimes statute, the creation of information
technology courts, and the mandatory acceptance and utili-
zation of electronic documents and electronic payments in
selected government agencies.
