INTRODUCTION
For some years, rules promulgated by international organizations for
multinational enterprises (MNE's) have been in existence and, in vary-
ing degrees, operative. These rules are set forth in documents prepared
by the International Chamber of Commerce (ICC), the Organization
for Economic Cooperation and Development (OECD), and the Interna-
tional Labor Organization (ILO). This article will provide some basic
information regarding these documents and their operation in practice.
This article also seeks to appraise their legal characteristics, their ex-
isting or prospective impact on international business, and their contri-
bution to United Nations efforts to develop a code of conduct for
transnational corporations.'

1. The first formal discussion in the United Nations of multinational enterprise activity was
occasioned by Chile's complaint to the Economic and Social Council concerning ITT in 1972. 53

Council directed the U.N. Secretary General to appoint a group of eminent persons to study and
report on the international role of multinational enterprises. ECOSOC Res. 1721, 53 U.N. ESCOR

Group of Eminent Persons, The Impact of Multinational Corporations on Development and on

the United Nations established the Commission on Transnational Corporations. ECOSOC Res.

recommended the establishment of an Intergovernmental Working Group to formulate a code of

ernmental Working Group issued a draft code of conduct that has served as the basis for further
