U.N. COMMISSION ON INTERNATIONAL TRADE LAW (UNCITRAL)
The 6th Session of the UNCITRAL was held from April 2-13, 1973. The
following is a summary of the Commission's work at this Session.
The Working Group on the International Sale of Goods, which had held its 4th
Session from Jan. 22 - Feb. 2, 1973, was asked to pursue and complete its work
expeditiously. The Commission also decided to examine at its 1974 Session a proposal
from the International Institute for the Unification of Private Law, transmitting the
text of a draft of a law for the unification of certain rules relating to the validity of
contracts of international sale of goods which invited the UNCITRAL to consider
this draft. In this connection the U.N. General Assembly has decided that an
international conference of plenipotentiaries be held in New York from June
17 - July 12, 1974 to consider the Draft Convention on Prescription (Limitation) in
the International Sale of Goods.
UNCITRAL had before it a Secretariat study on the feasibility of developing
general condition of sale and standard contracts embracing a wide range of
commodities. The Commission decided to continue its work on the preparation of a
set of uniform conditions, in cooperation with various interested international bodies,
and to establish, if necessary, a group of experts on the subject.
With regard to international shipping legislation, revised international rules
governing the liability of a shipowner in the event of loss or damage to goods
transported by sea was the main subject considered by the Working Group on
International Legislation on Shipping at its 4th and 5th Sessions in September, 1972
and February, 1973 respectively, This Working Group has been asked by UNCITRAL
to continue its work.
The Working Group on International Negotiable Instruments held its 1st Session
in January 1973 when it studied a preliminary draft uniform law on international bills
of exchange and international promissory notes, with commentary, prepared by the
Secretariat in consultation with interested international organizations and banking and
trade institutions. Similarly, this Working Group is to continue its work.
The Commission had before it parts of three reports of a working party of the
Commission on Banking Technique and Practice of the International Chamber of
Commerce (ICC), setting forth proposed revisions to the Uniform Customs and
Practice for Documentary Credits, originally drawn up in 1933 and revised in 1951
and 1962. The proposed revisions are to be communicated to governments and an
analysis of the latter's observations prepared. The Commission also asked the ICC to
submit progress reports on this subject and the revised text of the Uniform Customs
prior to its final adoption by the ICC.
The Commission had before it a Secretariat report which suggested, inter alia,
that the UNCITRAL prepare a set of rules for optional use in ad hoc international
commercial arbitration. The Commission accepted this proposal and a draft set of such
rules is to be prepared, in consultation with various interested organizations, for
consideration at the 1975 Session of the Commission.
The U.N. General Assembly decided in November 1972 to ask the UNCITRAL
to seek from governments and interested international organizations information
relating to legal problems presented by the different kinds of multinational enterprises
