Duluth is the first city in Minnesota to coordinate law enforce-
ment, criminal justice and human service agencies on the issue of
domestic abuse. The purpose of the coordination is to adopt a com-
mon set of policies and procedures directed at providing a uniform
response to assailants in domestic assault cases. Under the umbrella
of the Domestic Abuse Intervention Project (DAIP), nine agencies
participate in this effort. The program's ultimate goal is to reduce
the number of victims in Duluth experiencing continued assaults by
their partners. It is designed to accomplish this goal by placing the
responsibility for controlling the assailant on the law enforcement
and criminal justice system while offering educational and support
systems for the purpose of changing assailants' behavior.
This article describes Duluth's Domestic Abuse Intervention
Project and focuses on the criminal justice system's response to as-
sault cases involving intimate partners.
TRADITIONAL RESPONSES TO DOMESTIC ASSAULT CASES
In recent years law enforcement and criminal justice agencies
have been heavily criticized for what many believe to be an inade-
quate response to domestic assault cases. A review of the literature
and published research examining the effectiveness of traditional re-
sponses depicts the need to re-examine public policy in this area and
has led many to the conclusion that traditional responses actually
contribute to perpetuating violence within families. Two points are
consistently raised in the research on the nature of the criminal jus-
tice system's response to battering. First, the nature of the relation-
ship of the victim to the assailant tends to make both criminal
justice and law enforcement officials treat these cases differently
from other assaults. Second, there is no consistency in the responses
within the overall criminal justice system or even within an individ-
ual community's court and police departments.
Police reluctance to interfere in family disputes has been noted
