This work brings together all significant material leading to the 1909 Copyright Act. Much of
this material has been available previously only in the Copyright Office.
To make the work more thanjust a scholarly or archival curiosity, and to facilitate its use as a
tool in day-to-day copyright research, a detailed subject matter index has been prepared and
included. In addition, a section-by-section conversion table has been included to cross
reference codified sections of the copyright law, Title 17 U.S. Code, with the corresponding
or analogous sections of the 1909 Act and the more important pre-1909 revision bills.
Even with the passage of a new copyright law in 1976, the pre-1909 legislative proceedings
will continue to be immediate and relevant to contemporary copyright matters. The 1976
revision bill, of course, makes considerable changes in the substantive and procedural law
affecting copyrights. Pre-existing copyrights as well as the renewal procedure for millions of
subsisting copyrights, however, would still depend on the provisions of the 1909 Act. Also, a
proper understanding of the 1909 Act would still influence if not control certain concepts
such as what are the standards of copyrightability, what determines when a work has been
made for hire or written as a work ofjoint authorship, what constitutes fair use and so on.
In addition, many so-called new features of the copyright revision bill, such as the term of
protection for the life of the author and fifty years, automatic copyright at the time of creation
and compulsory licensing, were extensively discussed and evaluated in the pre-1909 legisla-
tive proceedings.
E. Fulton Brylawski is a member of the District of Columbia Bar and is the author of a
number of articles on copyright law. Abe Goldman was formerly General Counsel of the
Copyright Office and Acting Register of Copyrights. He is a member of the Bar of Illinois and
Indiana, is co-editor of Copyright Laws and Treaties of the World and author of numerous
articles on copyright law.
