    Application of

         TEXAS INTERNATIONAL AIRLINES, INC.           Docket 24702

    to temporarily suspend service at
    Victoria, Texas.


                                   FINAL ORDER

         By Show Cause Order 72-11-115, dated November 27, 1972, the Board
    directed all persons to show cause why the Board should not issue an
    order (a) making final the tentative findings and conclusions stated
    therein, and (b) granting the requested suspension authority.  The order
    required that all interested persons having objection to the issuance of
.an order making final the proposed findings, conclusions, and suspension
    authorization set forth therein file such objections within 21 days after
    service.

         An objection to the finalization of the show capse order has been
    received from the Airline Pilots Association, International (ALPA), 1/
    and a response thereto was filed by Texas International Airlines, Inc. 2/

         In its objection ALPA raises arguments similar to those advanced
    in its objection to Show Cause Order 72-9-39, dated September 12, 1972.
    The latter order was similar to the present case in that it dealt with
    air carrier suspensions, contingent upon air taxi replacement service.

         In Order 73-1-3, dated January 2, 1973, we considered ALPA's
    objections to Order 72-9-39. in detail and concluded that none of these
    objections persuaded us that it would be inappropriate to make final the
    Board's tentative findings and conclusions. 3/  Our findings are applicable
    to the present case, and we adopt the reasons set out in Orders 73-1-3, and
    73-1-49 and conclude that the tentative findings and conclusions contained
    in Order 72-11-115 should be made final and that:


    1/  Filed December 1, 1972.
    2/  Filed December 22, 1972.
    3/ By  Order 73-1-49, January 15, 1973, the Board denied ALPA's request for
  *evidentiary hearings  in certain other suspension/substitution cases since no
    showing had been made of any matters which required such hearings.  Here too
    ALPA essentially reiterates its general opposition to substitution arrangements
    without setting forth any contrary evidentiary or statistical data or indicating
    what material facts it would expect to establish through an evidentiary hearing.
