                         ORDER DISMISSING COMPLAINT

     By tariff revisions  1/ marked to become effective  on January 3, 1973,
United Air Lines, Inc.  (United) proposes to add an exception to the normal
10:00 p.m.-4:00 a.m. application of deluxe night coach/night  coach fares in
order to permit the use of these fares on flights  scheduled to depart from
the origin terminal of Cleveland to Atlanta and Miami between  the hours of
9:30 p.m. and 4:00 a.m.

     Eastern Air Lines, Inc.  (Eastern) has requested investigation and
 suspension of the proposed exception, alleging that it has not been shown to
 be a warranted deviation from the Board's off-peak coach policy; that United's
 justification is incomplete, containing no load factor data or other information
 to demonstrate the off-peak nature of the flight; that advancing the departure
 time by half an hour would divert heavily from Eastern's 10:00 p.m. night coach
 flight under the guise of being an off-peak service; and that, unlike many other
 midwest-Florida markets, there is no time zone differential and therefore no
 legitimate reason to advance the departure time.

     In support of its proposal and in answer to the complaint, United  alleges
that it presently provides Cleveland-Atlanta night coach  service on one flight
per day departing at 10:00 p.m.; that it proposes to exten-d this service to
-Miami and also advance the Cleveland departure time in order to permit a more
efficient use of aircraft and crew time during off-peak hours;  that the earlier
departure time is necessary to maintain its present schedule pattern with  the
aircraft-at other points and that if forced to operate the  flight at normal day
