      Application of

         FEDERAL EXPRESS CORPORATION           :            Docket 24293

      for an exemption pursuant to
      section 416(b) of the Federal
      Aviation Act of 1958, as amended.



                             ORDER GRANTING EXEMPTION

           By application filed March 10, 1972, Federal Express Corporation
* (Federal) seeks an exemption from section 401 of the Act and section
      298.21(a) of the Board's Economic Regulations 1/ to the extent they
      would otherwise prohibit it from using certain Fan Jet Falcon aircraft
      that have a maximum gross take-off weight of 28,660 pounds.

           In support of its application Federal alleges, inter alia, that it
      is a registered air taxi operator; that it intends to commence planeload
      charter operations using D model Fan Jet Falcon aircraft; that due to
      engineering modifications D model Falcons have a gross take-off weight of
      28,660 pounds; that no increase in capacity results from the modifications;
      that seating capacity is nine seats plus one jump seat; and, that the
      Board has granted similar exemptions in the past.

           No objections to grant of this application have been filed.


      1/  Section 298.21 limits the exemptions granted to air taxi operators
      to air transportation conducted, inter alia, in planeload charter flights
      in turbo-jet aircraft having a maximum certificated take-off weight of
      over 12,500 pounds and under 27,000 pounds and a maximum passenger
      capacity of not more than twelve persons.
