Order 71-6-1

                       UNITED STATES OF AMERICA ,
                       CIVIL AERONAUTICS BOARD
                          WASHINGTON, D. C.

Adopted by the Civil Aeronautics Board
at its office in Washington, D. C.
on the 2nd day of August, 1971

Application of

BASLER FLIGHT SERVICE, INC. Docket 23457

for an exemption from section 401
of the Federal Aviation Act of 1958,
 as amended.

            ORDER DISMISSING PETITION FOR RECONSIDERATION

By Order 71-6-88, dated June 16, 1971, the Board denied an application
of Basler Flight Service, Inc. (Basler), a commercial operator, for an
emergency exemption to operate ten one-way flights between points in the
upper midwest and Reindeer Lake, Saskatchewan, Canada, pursuant to contract
with Arctic Lodge, a fishing resort at Reindeer Lake. The flights were to
have been operated with 25-passenger DC-3 aircraft between June 6, 1971 and
June 17, 1971.

On July 6, 1971, Basler filed a Petition for Reconsideration of
Order 71-6-88, alleging that the factual predicate for the order was
erroneous. Basler alleges, inter alia, that, in terms of price
differential, Interstate Airmotive, Inc. (Interstate) is not able to
provide the service on reasonable terms; that Interstate does not possess
aircraft or crew sufficient to operate the service; that Interstate does
not possess the authority to operate the flights; and, thus, there is no
certificated air carrier who is fit, willing, and able to provide this
service on reasonable terms.

On July 21, 1971, Interstate filed an answer. 1/

The Board has decided to dismiss the petition for reconsideration
as moot. The application was for authority to operate ten one-way
flights commencing June 6, 1971, and ending June 17, 1971. The period
for which exemption was sought has now passed. Accordingly, the Board
finds that Basler's petition for reconsideration of Order 71-6-88 is
moot and should be dismissed. 2/

1/ The Acting Chief Examiner acceoted Interstate's late-filed answer.
f/ In any event, Basler', petition does not establish error in the Board's
original decision or present any matters that otherwise would warrant grant
of the relief sought.
