Issued under delegated authority July 11, 1969 Application of UNIVERSAL AIRLINES, INC. Docket 21175 for an exemption pursuant to section 416 of the Federal Aviation Act of 1958, as amended. ORDER GRANTING EXEMPTION AND DEFERRING ACTION By application filed July 7, 1969, in Docket 21175, Universal Airlines, Inc. (Universal) seeks an exemption from sections 401 and 403 of the Federal Aviation Act in order to wet lease to World Airways, Inc. (World) a four engine DC-8-55F jet aircraft for the period July 13, 1.969 through September 30, 1969, to be operated in any area in which Worid is authorized to operate. The parties contemplate, however, that the aircraft will be used for the fulfillment of World's transatlantic charter commitments The first flight is scheduled to depart on July 13, 1969, from New York, New York for Munich, Germany. In support of its application Universal, alleges, inter alia, that due to an unexpected increased demand by the Military Air Command for the first quarter of FY 1970, World needs additional lift; that World has attempted to lease an aircraft from all United States 707-320 operators, including those supplemental carriers with transatlantic authority; that some of the carriers contacted offered to carry selected individual trips, which if combined fail to meet more than a.token portion of World's commitments; that Universal's aircraft is programed for continuous use by World; that the lease runs for a maximum of 80 days; that this lease explicitly meets all of the criteria of the Board's wet lease policy as set forth in section 399.19 of the Board's Regulations; that Universal. is guaranteed a maximum of 365,000 statute miles during the full term of the lease at $2.50 per mile; and that World represents that no carrier is able to accommodate the flight on July 13th. In view of the immediacy of the first flight date, time does not permit awaiting expiration of the ten-day period for filing objections. Accordingly, we will act on Universal's application with respect to the first flight, and will defer action on the remainder pending expiration of the period for filing objections.
