Application of

     SIS-Q FLYING SERVICE, INC.                    Docket 31743

for an exemption pursuant to
section 416(b) of the Federal
Aviation Act of 1958, as amended


                          ORDER DENYING EXEMPTION

     By application filed November 23, 1977, Sis-Q Flying Service, Inc.
(Sis-Q), requests an exemption from section 401 of the Act in order to
engage in cargo charter operations between Miami, Florida, and San Juan,
Puerto Rico, for the duration of the Longshoremen's strike affecting
East Coast ports and for a period of sixty days after the end of that
strike.

     In support of its request Sis-Q alleges, among other things, that
the Longshoremen's strike has created a severe traffic problem between
Puerto Rico and the United States; that shippers and air freight forwarders
have developed large backlogs of freight awaiting transport; and that
arrangements. have been made with an air freight forwarder to make available
adequate air cargo capacity to meet that forwarder's needs.

     On December 1, Rich International Airways (Rich) filed an objection
to Sis-Q's application. Rich states that it is prepared to handle those
flights which Sis-Q's customer, Novo Airfreight, can identify by date of
operation, subject to aircraft availability. In fact, Rich had already
committed its DC-6 aircraft to Novo on December 5 and 6. Novo also
indicated to Rich that it required additional capacity but was unable at
that time to propose specific dates of operation. 1/


1/   Novo later informed Rich that it needed capacity on December 2, 3, 4,
5, 6, 7, 8 and 9. As previously stated, Rich and Novo contracted for
flights on the 5th and 6th, but Rich had no aircraft available on the
other dates. Therefore, in an amendment to its objection, filed on
December 2, Rich stated that it would not object to Sis-Q's operating
flights for Novo on December 2, 3, 4, 7, 8 and 9.
