Application of

  ALITALIA-LINEE AEREE ITALIANE S.p.A.                  Docket 41729

for an emergency exemption under section
416(b) of the Federal Aviation Act of 1958,
as amended



                       ORDER DISMISSING APPLICATION

     By application filed September 29, 1983, Alitalia-Linee Aeree
Italiane S.p.A. requested an emergency exemption under section 416(b)  of
the Act to permit it to operate its regularly scheduled New York-Rome, all
cargo flight AZ923 over a New York-Algiers-Rome routing on October 8,
1983.  The carrier stated that the request was necessary in order to
transport 60,000 lbs of perishable cargo, which required prompt shipment,
between New York and Algiers.

     After orally advising the staff of several changes in flight dates,
on November 7, 1983, Alitalia filed a notice withdrawing its request,
stating that the cargo could be accommodated on existing Alitalia
flights.

     In light of Alitalia's notice, its application is moot, and we shall
dismiss it.

     Accordingly, acting under authority delegated by the Board in its
Regulations, 14 CFR 385;

     1.  We dismiss the application of Alitalia-Linee Aeree Italiane
S.p.A. in Docket 41729; and

     2.  We may amend or revoke this order at any time without hearing.

     Persons entitled to petition the Board for review of this order
under the Board's Regulations, 14 CFR 385.50, may file their petitions
within ten days after the date of service of this order.
