Docket 38986 for unused authority under section 401(d) (5) (D) of the Federal Aviation Act of 1958, as amended. ORDER On November 21, 1980, Mississippi Valley Airlines, Inc. (MVA) filed an application under section 401(d) (5) (D) of the Act for unused authority in the Indianapolis, Indiana- Chicago, Illinois (IND-ORD) market. In the Indianapolis- Chicago market the authority of Braniff Airways, Inc., Delta Air Lines, Inc., Northwest Airlines, Inc., Trans World Airlines, Inc., Western Air Lines, Inc., Ozark Air Lines, Inc., Piedmont Aviation, Inc., and Republic Airlines, Inc. is unused within the meaning of section 401(d) (5) (D). l/ The incumbent carriers have not filed a notice of intent to institute service under section 401(d) (5) (G) (i) and MVA's application is the only one we have received seeking the authority requested. No answers have been filed. We will therefore grant MVA's application for unused authority in the Indianapolis-Chicago market, Docket 38986. l/ In its application MVA incorrectly stated that the authority of Eastern Airlines, Inc. (Eastern) is unused in the Indianapolis-Chicago market. In May, 1980, Eastern served that market and, therefore, its authority is not unused according to section 401(d) (5) (D).
