O nVE I 2 Issued by the Department of Transportation on the 2nd day of April, 1990 Ninety-Day Notice of ROCKY MCLUTNIN AIRWAYS d/b/a CQNTINENTAL EXPRESS under section 419 of the Federal Aviation Act of 1958, as amended, to terminate service at AIamosa, Colorado Docket 45591 ORDER EXTENDING SERVICE OBLIGATION On April 19, 1988, Rocky Mountain Airways d/b/a Continental Express, filed a 90-day notice of its intent to terminate service at Alamosa, Colorado, effective July 19, 1988. By Order 88-6-43, June 30, 1988, the Department prohibited the carrier from terminating its service for an initial 30-day period, while we instituted an essential air service replacement case. As required by section 419, we have extended Rocky Mountain's service obligation for additional 30-day periods. The latest extension, through April 9, 1990, was issued by Order 90-3-15. Order 88-6-43 also requested proposals for replacement service. We received proposals from Rocky Mountain and Mesa Airlines, and rate negotiations with the carriers were conducted. By Order 90-1-38, January 22, 1990, the Department selected Mesa Airlines to provide essential air service at Alamosa. However, on February 14, 1990, Rocky Mountain filed a Petition for Reconsideration of Order 90-1-38. Because of this petition, Mesa has decided that it will not institute its new service at Alamosa until the matter is resolved. Since this case will not be resolved before the end of Rocky Mountain's current hold-in period, April 9, 1990, in accordance with section 419(b) (5) of the Act, we will extend Rocky Mountain's service obligation in the Alamosa-Denver market for an additional 30-day period, through May 9, 1990. This order is issued under authority assigned in 14 CFR Part 385. ACCORDINGLY, 1. The Department requires Rocky Mountain Airways d/b/a/ Continental Express, to maintain service in the Alamosa-Denver market, as set forth in Appendix B of Order 88-6-43, for an additional 30-day period, through May 9, 1990, or until Mesa Airlines, Inc., actually begins service, whichever occurs first; l/ 1/ In accordance with section 419, we will extend Rocky Mountain's service obligation for successive 30-day periods, as necessary, until replacement service begins.
