SERVED MAR 7 Issued by the Department of Transportation on the 1st day of March, 1990 Essential Air Service at CLARKSBURG/FAI4ONT, WEST VIRGINIA Docket 42531 MOR1GANI-WN, WEST VIRGINIA under section 419 of the Federal Aviation Act of 1958, as amended ORDER DELEGATING AUTHORITY TO APPROVE INAUGURATION CF SERVICE By Order 90-2-10, dated February 5, 1990, and served on all parties on February 12, 1990, the Department tentatively selected Jet Express, Inc., to provide subsidized essential air service at Clarksburg/Fairmont and Morgantown, West Virginia. The selection of Jet Express was made tentative, pending the completion of an on-site review of the carrier's operations to insure that the carrier has the capabilities of providing reliable air service at the communities. Ordering paragraph 4 of the order specified that the selection of Jet Express would become final on the twenty-first day after the date of service of the order unless the Department issues an order to vacate or delay the final selection of the carrier; that date is March 5. We will not have conducted the on-site review of Jet Express by March 5. Therefore, we will amend ordering paragraph 4 of Order 90-2-10 to provide more time for the on-site review to be completed. Jet Express plans to institute service at Clarksburg/Fairmont and Morgantown on April 1, 1990. In order to insure that our review is as complete as possible, we will not conduct the on-site review of Jet Express until the week prior to April 1. Since a short period of time may transpire between our on-site review and the potential start-up of service by Jet Express, we will delegate to the Director, Office of Aviation Analysis, the authority to make the selection of Jet Express final and bo approve its start-up of subsidized essential air service at Clarksburg/Fairmont and Morgantown. When approval is given, a notice of such approval will be included in Docket 42531 and will be served on all parties served with a copy of Order 90-2-10.
