Docket 45508 for request for advance subsidy : payment ORDER By a series of orders, Exec Express, Inc., was selected by the Department to provide subsidized essential air service at ten communities -- Enid, Ponca City and McAlester, Oklahoma, Brownwood, Paris and Temple, Texas, and El Dorado/Camden, Harrison, Hot Springs, and Jonesboro, Arkansas, through October 23, 1988. 1/ The carrier's total annual subsidy rate for these services is $3,151,805. Exec Express has consistently pro- vided reliable and competent air service to these ten communities. On March 4, 1988, Exec Express filed for protection under Chapter 11 of the Federal Bankruptcy laws and immediately requested that the Department approve an advance subsidy payment for relief from a critical cash flow problem. The carrier requested a subsidy advance of $176,000, approximately three weeks' subsidy pay- ments. 2/ Exec Express proposed to repay the advance at a rate of $44,000 per month for four months, i.e., the Department would withhold $44,000 from each of its subsidy billings for the months of March, April, May and June 1988. On April 9, 1988, the Federal Aviation Administration (FAA) revoked Exec Express' Air Carrier Operating Certificate, primarily for maintenance infractions. The carrier immediately began correcting the problem areas raised by the FAA in an attempt to reorganize and become recertificated. The FAA and the Department of Transportation have closely monitored the carrier's progress 1/ Orders 86-8-89, 87-3-74, and 87-6-51. 2/ The carrier receives about $260,000 subsidy per month.
