Docket 43193 for an exemption pursuant to section 416(b) of the Federal Aviation Act of 1958, as amended (Newark, N.J.-Montreal (Mirabel International Airport), Canada) ORDER GRANTING EXEMPTION On June 10, 1985, People Express Airlines, Inc. filed an application for an exemption from section 401 of the Act in order to permit it to engage in scheduled foreign air transportation of persons, property, and mail between Montreal (Mirabel International Airport), Quebec, Canada, on the one hand, and Newark, New Jersey, on the other hand. People Express proposes to operate three daily nonstop roundtrips between Mirabel and Newark with B-727 aircraft. In support of its application, People Express argues that the authority it requests involves service between the U.S. and Canada using a specific underutilized airport -- Mirabel -- which is the subject of a developmental agreement between the United States and Canada; that it will provide a needed service in this market; and that it will assist in the development and maturation of this airport. People Express plans to institute its service on July 15, 1985. We received no answers to Peoples Express' application. 1/ By an'Exchange of Notes on August 21, 1984 (Nos. ETT-1482 and 299) as amended by an Agreed Minute of April 23, 1985, the United States and Canada agreed to an Experimental Transborder Air Services Program designed to foster new transborder air services and to gain experience with innovative pricing and service mechanisms on transborder air services. Under this experimental program, each party may designate any number of airlines to provide combination service over the route: 1_/ People Express requested expedited consideration of its application without awaiting the full period for answers. On June 12, 1985, we issued a notice calling for answers to the application by June 19, 1985.
