Issued Under Delegated Authority October 1, 1 984 Notice of intent of MID-SOUTH AIRLINES, INC. Docket 41929 to suspend service at Danville, Virginia, pursuant to section 419 of the Federal Aviation Act of 1958, as amended ORDER REQUIRING CONTINUATION OF ESSENTIAL AIR TRANSPORTATION On January 9, 1984, Mid-South Airlines, Inc., filed a 90-day notice of its intent to suspend all of its service at Danville, Virginia, effective April 8, 1984. 1/ Since the suspension of service at Danville by Air Virginia/Mid-South would deprive the community of essential air service, in accordance with section 419(a)(6) of the Act, by Order 84-3-14, dated March 1, 1984, the Board prohibited the carrier frcm suspending its service at Danville and extended the carrier's service obligation for a 30-day period, through May 7, 1984. We have renewed Air Virginia's obligation for additional 30-day periods. The latest period extends through October 4, 1 984. In the same order, the Board approved a subcontract arrangement between Air Virginia and Wheeler Airlines, effective March 1, 1984, under which Wheeler provides essential air service at Danville in place of Air Virginia on an interim basis. By Order 84-8-9, August 2, 1984, the Board tentatively approved a use-it-or-lose-it test of essential air service at Danville and selected Wheeler Airlines to provide the service. Objections to that tentative decision were due by September 10, 1984. No objections were received. We expect that the Board will issue a final order on this matter within the next several weeks. Since we will not complete the carrier replacement case by October 4, 1 984, we must require Air Virginia (through its subcontract arrangement with Wheeler Airlines) to continue to assure the provision of essential air service at Danville. Therefore, in accordance with section 419(a)(6) of the Act, we will extend Air Virginia's service obligation at Danville for an additional 30-day period. 1/ Pursuant to a contract of purchase, effective March 1, 1984, under which Mid-South Airlines merged with Air Virginia, Air Virginia assumed the essential air service obligation of Mid-South at Danville.
