ADR Systems Design Roundtable

Draws More than 100
   A large and enthusiastic audience of federal agency officials involved in their
agencies' ADR activities attended the Conference's most recent ADR roundtable
on February 2, 1993. The day-long program focused on the practical aspects of
designing systems for using alternative dispute resolution in federal agencies.
Several recognized experts in the field, including Stephen Goldberg of
Northwestern University Law School and Linda R. Singer of the Center for Dispute
Settlement, participated in the day's program.
   The program began with a panel discussion of the basic principles of dispute
system design, in which Ms. Singer and Professor Goldberg were joined by Cathy
Costantino, Director of the ADR Unit at the FDIC, who presented a federal
perspective. This was followed by a fishbowl exercise, during which Professor
Goldberg and Ms. Singer discussed with representatives from the U.S. Air Force's
Sacramento Air Logistics Center their newly-begun efforts to establish an ADR
program, focusing through a series of questions and answers on how to design a
dispute resolution system for contract disputes. In the afternoon, participants broke
into small groups, each focusing on building ADR processes into systems for
handling a typical type of dispute, such as EEO, personnel grievance and labor
relations, enforcement, contracts, litigation, and policy development.
   The roundtable is part of an ongoing series, designed to provide assistance to
agency officials in their implementation of the Administrative Dispute Resolution
Act. The next roundtable will be on May 25, on 'evaluating dispute resolution
systems.

Recommendations              on
Federal Administrative
Judiciary Reform
   Proposed changes to the selection and
management of the government's
administrative judiciary were formally
adopted (Recommendation 92-7) at the
December plenary.
  Recommendation    92-7  (The
Federal Administrative Judiciary),
calls upon Congress, when creating new
programs, to preserve the uniformity of
process and of qualifications of
presiding officers contemplated by the
1946 Administrative Procedure Act. To
do this, Recommendation 92-7 contains
guidelines for Congress to use in
deciding when to assign adjudications to
administrative law judges instead of to
non-APA administrative judges.
  Also urged is changing the ALI
selection process administered by the
Office of Personnel Management so that
