Wunder,
VS.
Henry Styer.
To the Honorable the Judges of said Court, the suggestion in
the words following of George W. Wunder, the above named
relator, respectfully sheweth and gives your Honors to understand
and be informed,
That the said George W. Wunder was on the 11th day of Oc-
tober last past, and is a citizen of the United States, over the age of
twenty-one years, having been born therein, and that he has been a
citizen and inhabitant of the state of Pennsylvania more than three
years next preceding the said 11th day of October, and still is a
citizen and inhabitant therein, the last year whereof and before, he
has been an inhabitant of the First Ward of the District of Spring
Garden in the County of Philadelphia, in which said ward he still
resides, during all which times and before he has been a qualified
voter.
That the thirty-third section of the act of Assembly passed
April the 12th, A. D. 1851, regulating certain election districts
and for other purposes, provides, That the qualified voters of
each of the wards of the District of Spring Garden shall, on the
second Tuesday of October next, and annually thereafter, at the
usual place of holding the general election and under the direction
of the officers who are authorized by law to conduct the same,
elect by ballot one citizen of each of the said wards in said district,
who, at the time of his election, shall be a resident of the ward for
which he is elected, to serve for Commissioner of said district for a
term of three years from the time of such election, in the place of
the Commissioner whose term expires. Provided, that the special
election to fill vacancies shall be held in accordance with existing
laws in the several wards of said district.
That there are seven wards in said District of Spring Garden,
and that at a general election held in said county on the said 11th
(lay of October, last past, being the second Tuesday thereof, the
said George W. Wunder received in said first ward at least four
hundred and ten votes for the office of a Commissioner of the
