RESPONDENT'S BRIEF ON APPEAL FROM JUDG-
MENT AND ORDER, DENYING NEW         TRIAL.
This action was brought to recover damages for the ab-
ducting, enticing, taking away, and harlorino- the plaintiff's
wife and child.

The plaintiff, aud Martha DeRemer, defendant's daughter,
were married Nov. 10th, 1861; they had two children, Grace,
born in Canada, Aug. 1864, and Fanny, born Aug. 1867,
(23); they lived in Bertie, Canada, about ten miles from
Buffalo, (22, 4). On May 16tb, 1871, the child Grace, was
at scehool, in the village of Ridgeway, near plaintiff's resi-
dence, sent there by her father, the plaintiff, (12, 13, 14, 31).
Fanny was at home with her father (28); the defendant
resides, and has always resided, at Ulysses, Tompkins
County, N. Y. On May 16th, 1871, the defendant drove
