POINTS FOR THE APPELLANT, MOSES COlT
TYLER AS ADMINISTRATOR, &c.
STATEMENT OF FACTS.
During the year 1888, John Tyler was the duly
elected and duly qualified Special County Judge of
Tompkins County. From the 9th day of February
to the 8th day of March inclusive in that year, Mar-
cus Lyon, the County Judge and Suirogate, was ab-
sent from the county and during this time the said
John Tyler acted as Surrogate, but the proof of his
authority which is referred to in sections 2484 and
2487 of the Code of Civil Procedure, was not made.
Subsequently, and on the 6th day of Alav, 1889, the
Leislature passed an Act, (Chap. 521, Laws of 1889)
providing that the official acts of the said John Tyler
