The issues in this action came on for trial before P.
G. Ellsworth, Esq., a referee duly appointed by the
Court to hear and determine the same, in the village of
Ithaca, N. Y., on the 7th day of August, 1876.
The plaintiff, by his counsel, having opened the case,
it was admitted that for some time prior thereto and
upon the 19th day of April, 1873, the plaintiff, Lewis
Head, was seized in fee simple of one hundred and nine
acres of land in the town of Danby, Tompkins county,
which are particularly described in a conveyance of the
same from George H. Fortner, recorded in Tompkins
County Clerk's office in Liber No. 1 of Danby deeds, at
page 331, and that the plaintiff was in the possession
thereof.
It was further admitted, that at the times above 2
mentioned the said one hundred and nine acres were in-
cumbered with a mortgage held by one Francis Nourse,
upon which there was unpaid $1,180 of principal and
about two years' interest, which had become due and
payable on the 1st day of April, 1873 ; that there was
no bond accompanying said mortgage.
