COOK, AND JOHN PECK.
The premises in question were attached in the suit in favor
of Cook, Lane & Corning, against B. Rathbun, in August
1836. [Bill p. 1.]
On the 7th October, 1837, Cook died, and the partnership
was continued, for the benefit of his family, to January 1,
1838. [Lane's dep. p. 1. Corning's dep. p. 1.]
Final judgment was perfected in the suit in March 1838.
Execution was issued April 19th, and was levied May 18,
1838. [Bill, p. 4. Answer p.,2.]
Suydam became a member of the firm in February 1837,
and its style then was, Cook, Lane, Corning 4- Co. This
firm assumed all the liabilities, and took all the assets, of
Cook, Lane & Corning. [Corning's dep. pp. 1, 2, 3.]
After January 1, 1838, the business was conducted by Lane,
Corning & Suydam, who assumed all the liabilities, and be-
came possessed of all the assets, of the old firm, including
the right to the premises in controversy. The assets fell far
