This suit was instituted to procure a partition of certain premises
situated in and near the village of Syracuse, in the county of Onon-
daga, and generally known as the property of  The Syracuse Com-
pany, and a division of the personal property belonging to the
company, and a full and final settlement of its affairs. The origi-
nal bill was filed on the sixteenth day of September, 1844. Henry
Q. Hawley appeared as solicitor for the defendants, Gideon Haw-
ley, John B. James and wife, Henry James and wife, Gideon Haw-
ley trustee and executor, and Moses D. Burnet. Aaron Vander-
poel appeared as solicitor for the defendants James McBride and
wife. The defendant, Mary Ann King, having on the 18th day of
September, 1844, intermarried with Minturn Post, and the defend-
ants Henry Mason, and Lydia L., his ,wife, having by deed bearing
date the first day of October, 1844, conveyed their interest in the
premises of which partition was sought, to the complainant, Augus-
tus James ; and the defendant, Catharine Margaret Temple, wife of
the defendant, Robert E. Temple, having on the ninth day of No-
vember, 1844, given birth to a daughter named Clara Temple, leave
