To standardize leave of absence of employees of the Government of the Vir-
gin Islands of the United States.
BE IT ENACTED by the Legislative Assembly of the Virgin Islands of the United States
in session assembled:
Section 1. All officers and employees of the Municipality of St. Thomas and St. John,
and the Municipality of St. Croix regardless of their tenure, in addition to any accrued
leave, shall be entitled to'26 days annual leave, each calendar year exclusive of Sundays
and Holidays, provided, that the part unused in any year shall be accumulated for suc-
ceeding years until it totals not exceeding 60 days: Provided further that no money shall
be paid in lieu of leave.
Section 2. The annual leave herein authorized shall be granted at such times as the
heads of various departments and activities of the Municipal Government may prescribe.
Section 3. All officers and employees of the Municipality of St. Thomas and St. John,
and of the Municipality of St. Croix, regardless of their tenure, upon certification from a
practicing physician, or by affidavit for a period of illness of less than four days, shall be
entitled to cumulative sick leave, with pay, at the rate of 1/4 days per month, the total
accumulation not to exceed 90 days; provided, that 30 days sick leave, with pay beyond
accrued sick leave may be advanced upon approval of the Governor with the advice of the
Municipal Committee in cases of serious disability or ailments and when required by the
exigencies of the situation.
Section 4. Temporary eimployees, except temporary employees engaged on construc-
tion work at hourly rates, shall be entitled to 1/4 days sick leave for each month of service
upon certification as herein provided in Section 3.
Section 5. The annual leave herein authorized shall not be granted to teachers in
the public schools of the Municipalities who are entitled to pay for school vacations.
Section 6. Leaves of absence herein provided for shall be administered under such
regulations not inconsistent with the provisions of this act as the Governor of the Virgin
Islands may prescribe, so as to obtain, so far as practicable, uniformity in the application
of this law.
Section 7. This law shall take effect on January 1, 1939.
Thus passed by the Legislative Assembly of the Virgin Islands of the United States,
St. Thomas, November Z1, 138.
