Except as otherwise provided by law all purchases and contracts for supplies, equipment or services, in any of the Departments of the Government of the Municipality of St. Thom- as and St. John, except for personal services, shall be made by the Finance Officer by advertising a sufficient time previously for proposals respecting the same, when the public exigencies do not re- quire the immediate delivery of the articles, or performance of the service. Section 2. When immediate delivery or performance is required by the public exigency, the articles or service required may be procured by the Finance Officer by open purchase or contract at the places and in the manner in which such articles are usually bought and sold, or such services engaged between individuals. Section 3. The purchase of supplies and equipment or the procurement of services for the Government of the Municipality of St. Thomas and St. John, the offices and Departments thereof, may be made by the Finance Officer in open market without compliance with sections 1 and 2 hereof in the manner common among businessmen when the aggregate amount of the purchase or the ser- vice does not exceed $500.00 in any instance. Provided, that heads of departments may make in- formal, non-competitive contracts in v.riting, for performance of services or execution of repairs and construction, with the person to perform the work, when the aggregate amount of the contract does not exceed $50.00 in any instance: Provided further, that purchases of supplies and material may be made in the open market by heads of departments, upon written order, and without competition, when the aggregate amount of the purchase does not exceed $10.00 in any instance and $75.00 in any one month, except in cases of emergency. Section 4. Whenever proposals for supplies have been solicited, the party responding to such solicitation shall be duly notified of the time and place of opening the bids and be permitted to be present either in person or by attorney, and a record of each bid shall then and there be made. Section 5. Except as otherwise provided by law, and unless the Finance Officer, with the ap- proval of the Governor shall determine it to be inconsistent with the public interest, or the cost to be unreasonable, only such unmanufactured articles, materials and supplies as have been mined or produced in the United States, and only such manufactured articles, materials and supplies as have been manufactured in the United States substantially all from articles, materials or supplies mined, produced, or manufactured, as the case may be, in the United States, shall be acquired for public use; provided that where the bid is on foreign goods and for $100.00 or less, a differential of 50% will apply; provided, further, that where the bid is on foreign goods and exceeds $100.00, a differ- ential of 25% will apply; and provided further that this Section shall not apply if articles, materials, or supplies of the class or kind to be used, or the articles, materials or supplies from which they are manufactured are not mined, produced, or manufactured, as the case may be, in the United States, in sufficient and reasonably available commercial quantities and of a satisfactory quality. The pro- visions of this section shall not apply to the purchase of material, articles, or supplies paid for from special funds. Section 6. No contract or purchase on behalf of the Municipality of St. Thomas and St. John shall be made unless the same is authorized by law or is under an appropriation adequate to its ful- fillment. Section 7. Except as otherwise provided by law every contract made on behalf of the Muni- cipality of St. Thomas and St. John, by officers appointed to make such contracts, shall be reduced
