B E it enacted by the People of the State of .Aew.York, refiresentrd in Senate and Aosembly, That David Thomas, of the county of Wash, ington, be and he hereby is coistituted and iopointed treasurer of this state, to continue in office until the eighth day of iV'ebruary, which will be in the year of our Lord one thousand eight hundred and thirteen. C H A 1 IL Ax ACT to amend an Act, entitled A.n 4ct to divide the Town of Tully,' in the County of Onondaga, lasscd dfpril 8th, 1811. Passed February 8, 1812. E it enacted by the Peopde of the State of .ew.York, re/tresen ed im Senate and loiembly, That all that part of the first section of said act, that provides that a division of said town of Tully shall take place from and after the first Tuesday in April next, shall be and is hereby amend- ed, so as that all the powers and privileges granted to said towns of Tiilly and Spafford by said act. shall take effect and be in full force from and af- ter the first Tuesday in March next, any law to the contrary notwithstand- ing. C I A P. III. AN ACT amending and further extending, the Benefits of the Act relative to Mlfortgages executed to the People of this State. Pasmied February 8, 1812. DE it enacted by the Peopde of the State of Ycw-York, repiresented im I B Senate and Assembly, That the comptroller of this state is hereby authorized and required, in opening accounts in his office in pursuance of the act, entitled an act extending the benefits of the act, entitled an act relative to mortgages ex':cuted to the people of this state, against any per- son owning a part oi subdivision of any lot of land purchased from this state, for the proportionate part of the consideration due to the state on any such part or subdivision, (whether the same be due on bond or mortgage, or both) to gihe credit to such person for all such sum or sums of money, au shall ap- pear by satisfactory proof to have been intended to have been paid on any such part or subdivision, whether so specified in his receipt or not, and fur- ther, that Wlien any person shall apply in pursuance of the provisions of said act, or of the act thereby extended, to pay off and obtain a discharge of any part or subdivision of a' lot, the said comptroller ,hall in like manner allow credits for such receipts as may have been intended to have been paid on such part or subdivision: Provided however, That in all cases the per- son obtaining such credits as aforesaid, and a certificate from the comp- troller, stating the amount remaining due (when any) on any such part or subdivision, shall thereupon deliver up his receipts, in order that they may be filed in the comptroller's office: Anditrovided alo, -That the provisions of this act shall be construed to extend only to the benefit of such pCCbOn as shall apply to have accounts opened in pursuance of sai ftrt rcked act, A frtrc~dat
