1                                AN ACT
2    RELATING TO PROCUREMENT; AMENDING AND ENACTING SECTIONS OF THE
3    PROCUREMENT CODE; EXPANDING THE APPLICABILITY OF COMPETITIVE
4    PROPOSAL CONTRACTING; PROVIDING FOR AN ADVISORY COMMITTEE.

6    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
7          Section 1. Section 13-1-67 NMSA 1978 (being Laws 1984,
8    Chapter 65, Section 40, as amended) is amended to read:
9          13-1-67. DEFINITION--LOCAL PUBLIC BODY.--Local public
10    body means every political subdivision of the state and the
11    agencies, instrumentalities and institutions thereof,
12    including two-year post-secondary educational institutions,
13    school districts and local school boards and municipalities,
14    except as exempted pursuant to the Procurement Code.
15         Section 2. Section 13-1-111 NMSA 1978 (being Laws 1984,
16    Chapter 65, Section 84, as amended) is amended to read:
17         13-I-I1. COMPETITIVE SEALED PROPOSALS--CONDITIONS FOR
18    USE,--
19               A. Except as provided in Subsection G of
20    Section 13-1-119.1 NMSA 1978, when a state agency or a local
21    public body is procuring professional services or a design and
22    build project delivery system, or when the state purchasing
23    agent, a central purchasing office or a designee of either
24    officer makes a written determination that the use of
25    competitive sealed bidding for items of tangible personal
