An A C T for regulating and flortening the Proceedings in
the Coirts of Law.
W       HER EAS the Praclice of profecuting, Suits in the Courts of Preamble,:,
Law are attended with many unneceflary Cuftoms and Forms,
both tedious and expenfive, and on Account thereof is a real Grievance
to the Inhabitants of the State.; for Remedy whereof,
SeF. I. BE IT ENACTED by the Council and General Affembly of this Mode of

State, and it is hereby Enaled by the Authoity of the fame, That all Ac. Adions for,

Supreme Court, or any Court oft'Common Pleas in this State, flall be peray., r,
commenced by Summons or Capias, and carried on and defended by
each Party, either in their own Perfons, or by their Attornies or Coun-
Iellors at Law, or by themfelves and their Attornies or Counfellors,
refpeclively ; and thai no more than one Summons or Capias ihall be
iffued againfi two or more Perfons bound in a Bond or other Specialty,
or equally chargeable upon .,a Contraft.where the Parties bound or an-'
fwerable can all be taken by one Capias. And all A&ions for. Recovery
of Money on Bonds, Bills, Notes of Hand, Book Accounts and Af-
fumpfits'of any Kind, fhall be called and filed Actions of Debt.: And
all or any of them, by which either of the Partiesin an Aaion may have
Demand againft the other, , hall be charged and plead in one A6cion ;.
and the Party .negle&ing to chai e or. plead the fame, fliall forever af-
terwards be barred from recovelping on Account thereof. Provided-ne- prv.
verthelefi, That Bonds, Bills, Notes, or Specialties of any Kind, bona
fide affigned over to another Perfon prior to fhch Ation, fhall 'not be
included therein, or excluded from Recovery by feparate Actions.
