E IT ENACTED BY THE S ENAT E AND FO USE op REPRESENTATIVES, IN GENERAL-COURT CONVENED, That the Judge of Probate, in faid A& mentioned, may and fhall, upon application of any tenant in common, joint tenant, or parcener of real eftate, order the part to him or her belonging, to be divided and fet off in feveraity, without ordering a partition of die whole among all the owners thereof, which feverance of any one owner's part being fo made and accepted, as the faid At direas for the partition of land and real eftate, held in common and undivided, fhall be good and valid. II.
