CHAPTER 78.1
House Bill No. 849
AN ACT relating to grand Juries; amending Chapter 905, Florida Statutes;
providing for extension of a grand jury term not to exceed ninety (90)
days to complete specified investigations; providing an effective date.
Be It Enacted by the Legis ature ol the State ol Florida:
Section 1. Chapter 905, Florida Statutes, is amended by enacting section
905.095, Florida Statutes, to read:
905.095 Extension of grand jury term.-
Upon petition of the state attorney or the foreman of the grand jury act-
ing ors behalf of a majority of the grand jurors, the circuit court may ex-
tend the term of a grand jury empaneled under this chapter beyond the
term of court in which it was originally empaneled. A grand jury whose
term has been extended as provided herein shall have the same composition
and the same powers and duties it had during its original term. In the event
the term of the grand jury is extended under this section, it shall be ex-
tended for a time certain, not to exceed a total of ninety (90) days, and
only for the purpose of concluding one or more specified investigative
matters initiated during its original term.
Section 2. This act shall apply to any grand jury which in presently
empaneled or to any grand jury empaneled subsequent to the effective date
of this act.
Section 8. This act shall take effect immediately upon becoming a law.
