CHAP. U3.-An AC'T to authorize the sale of certain Slaves now In the
Penitentiary.

Code ti~nuided  1. Be it enacted by the general assembly, that the twentieth seo-
tion (f the seventeenth chapter of the Code of Virginia (edition of
eighteen hundred and sixty) be amended and re-enacted so as to read
as follows:
Slave, ihow soid  § 20. In the case of a slave condemned to death, the governor
may order a commutation of the punishment, by directing that such
slave be sold at public auction, to be trans)orted beyond the limits
-of the Confederate States. The governor shall cause hii to be sold,
and the purchaser, before dtelivry to him of the slave, shall pay into
the treasury the'price agreed, and enter into bond, approved by the
governor, in the penalty of one thousand dollars, conditioned that the
slave shall within three months be transported beyond the limits of
the Confederato States, and shall never afterwards return into this
Fmrnl,' ip,.v state: provided, however, that in the ease of anyfemnale slave heretofore
and chilire,,  or hereafter convicted of any offence other than arson or a crime against
how old    a white person, which in the case of a free negro would have been
Funishable with death, such female slave, and the children of any

governor to be sold at public auction unconditionally, and without
requiring bond as aforesaid.

CIIAm. 64.-An ACT amending and re-enacting the Ist section of chapter
214 (Code of 1860), so as to provide for the punishment of Free Negro
Convicts in certain cases.
Passed February 23,1864.
Code amondedl  1. Be it enacted by the general assembly, that section first, chap.
ter two hundred and fourteen of the Code (edition of eighteen hun-
dred and sixty)'be amended and re-enacted so as to read as follows :
What diem,ei   § 1. A convict confined in the penitentiary, or in custody of an
felony      officer, thereof, 'shall be deemed guilty of felony, if he shall hill,
wound, or inflict other bodily injury upon an officer or guard of the,
penitentiary, or shall escape froni the penitentiary or such custody;
or who shlill escape from the custody of nny party who may have
hired said convict, when a free negro, or from the agent of such part
or shall break, cut or injure any building, fixture or fastening of t O
penitentiary, or any part thereof, for the purpose of escatping, or aid-
ing any other convIct, to esca e therefrom, or rendering the Imniten-
tiary less secure as a place of confinement; or shall make, procure,
secrete, or have in his possessicii any instrument, tool or thing for
the said purpose, or with intent to kill, wound or inflict bodily injury
as aforesaid; or shall resist the lawful authority of an officer or guard
of the penitentiary, for the said purpose or with such intent.
