assembly that tile interests of all persons concerned in tile said estate
will be greatly advanced by the inmediate sale of the same; and the
petition of Mary Al. Foote, the widow, executrix and principal devi-
see of the said testator, Francis L. Smith, his executor, and Law-
rence B. Taylor and Henry IV. Davis, attorneys and counsellors at
law of the other parties in interest, hath been presented to this gene-
ral assembly, praying the passage of a law whereby the aaid Francis
L. Smith, Lawrence B. Taylor and lHenry V. Davis may be empow-
ered to make sale of the said estate on certain terms in the said peti-
tion set forth:

Henry IV. Davis, who are hereby appointed commissioners for that l101V to he, F.11.
purpose, to make sale of the real estate in the proceedings in the
said suit mentioned, of which the said William II. Foote died seized,
at public auction, to the highest bidder, having first given public no-
tice or the time and place of sale, four weeks successively, by adver-
tisement in the National Intelligencer, and Alexandria Gazette, news-
papers published in the City of Washington and town of Alexandria.
2. Be it further enacted, That the said sale shall be made upon Terms or e.
the following terms, viz : the purchaser to pay down in cash, at the
time of the sale, ten per centum of the l)urchase money, and the re-
sidue thereof in ten equal annual instalments, counting from the day
of sale, with interest thereon at the rate of six per centum per an-
num from the said date, payable semi-annually, and to execute bonds
for the same, with approved sureties; the title to be withheld until
final payment be made; and if, upon the confirmation of the sale by
the said circuit superior court of law and chancery for tile county of
Alexandria, to which it shall le the duty of the said commissioners
forthwith to make report of their proceedings, the purchaser shall
fail to comply with the terms of sale, the ten per centum to be for-
feited, and the estate subject to be resold by order of the said court,
at the risk of the purchaser.
3. Be it farther enacted, That upon the coming in of the report Power to coirarn

it shall be lawful for the said court to confirm or set aside the sale,
and order a resale, as to the said court may seem proper, and to have
and exercise tile like power over the said estate and the proceeds of
its sale, and over tile purchaser thereof and his sureties, and over the
said commissioners, and to order the proper conveyances, in all re-
spects, as if the said sale had been made under the authority of its
own decree.
4. This act shall be in force from the passing thereof.     Commetncement.

sonal property, which may now be in possession of or under the con-
trol of said Rawlings as trustee aforesaid, or which may be in his
possession or under his control, at the time of the rendition of the
decree aforesaid, to John Blackwell of the state of Tennessee, who
