real estate, and the proceeds thereof, devised by Lucy Slaughter, deceused,

Whereas it appears to the general assembly of Virginia, by the pe- Preamble.
tition of Edmund Anderson, executor of Lucy Slaughter, deceased,
late of the City of Richmond, that his testatrix, a free woman of
colour, by her last will devised a certain parcel or lot of ground in
the City of Richmond, to be sold by her said executor, and the pro-
coeds equally divided between her three grandchildren, Clara, Dinah
and James, the first two of whom are slaves for life, and the last is
entitled to his freedom at the age of thirty years: and that the said
executor has made sale of the said lot, and the proceeds thence arising
are now under the control of the superior court of chancery for the
Richmond circuit, in a suit therein depending under the style of the
Attorney General of the Commonwealth of Virginia against Lucy
Slaughter's executor and others, in which the said attorney general,
on behalf of the president and directors of the Literary fund, is now
asserting a claim to the said proceeds upon the ground that the said
devisees are in law incompetent to take under the said will: There-
fore,
1. Be it enacted, That all the estate, right, title and claim what. nigin of state to
soever, which has accrued or may hereafter accrue to the common- property ofLucy

of the balance, or so much as may remain after deducting all proper
costs and charges of administration, for the use, benefit and behoof
of the said devisces, according to the true intent and meaning of the
said will: Providcd nevcrtheless, That if from any cause it should
be in the judgment of the said court impracticable so to apply the
shares of the said Dinah and Clara, or either of them, as to benefit
them or their descendants, then their shares, or the share of that one
as to which such impracticability may exist, shall be applied for the
benefit of the said James or his descendants.
3. This act shall be in force from the passing thereof. Commencement.

payment of a sum of money out of the Literary fund to the representatives
of Joseph Gatewood, deceased, passed February 12, 1844.

Whereas it is represented to the general assembly, that on the Preamble.
twelfth of February eighteen hundred and forty-four, an act was
passed, allowing to tie representatives of Joseph Gatewood, deceased,
the sum of five hundred and eleven dollars and fourteen cents, for
land which belonged to said Gatewood, but which on his death cs-
cheated to the commonwealth, and was sold by order of the execu-
tive; that of the above sum only two hundred and nineteen dollars
and six cents have been paid, leaving still in the treasury the sum of
two hundred and ninety-two dollars and eight cents for distribution:
And whereas it appears that only five of the representatives of said
Gatewood are now living, all of whom have established their identity
