Be it enacted by the general ass mbly, That it shall no be oysters in Nnuso- f znond-iverr lawf ul for any person to take or catch oysters, except for the use of Uhuckutuckcrook, his, her or their families, in the waters of Nansemond river, and Withl era i nII lie. - Itod. , tie branches thereof, above Leogan's shioals on said river, nor in the waters of Chuckatuck creek, acid the branches thereof, above Ed- win Godwin's landing. on said creek, at any time between ihe first day of May, and the first day of September in any year. Be it fitrther enacted, That if any person.shall so take or catch oysters, every such person so offending shall, for every such offence, forfeit and pay the sum of twenty dollars, to be recovered by warrant before any justice Of the peace of the county of Nanse- mond, or of any county adjoining the waters in which the'offence shall have been committed, or in which the offender or defendant may reside, or be found, one half of which sum shall go to the in- former, and the other half to tie use of the.conmonwealth, for the benefit of the literary fund. siastors ansyleta. 3. Be it further enacted, That any master, mistress or employer bin for acts of slaves. of any slave, who shall, with the consent of such master, mistress or employer, violate the provisions of this act, (to establish which no previous conviction of the slave shall be necessary,) shall be held answerable for such act of his, her or their slave, as if such act was committed by such master, mistress or employer, in person, and subject to the same penalties.
