Portsmouth and Roanoke rail-road company, and for other purposes, passe

Powerto purchaso  1. Be it enacted by the general assembly, That the president and
land for dopot, directors of the Portsmouth and Roanoke rail-road company be, and
they are hereby authorized, at those points in the line of their rail-
road where it may appear to them important for the accommodation
of the trade and business of the road, to establish depots and ware-
houses, to purchase land, nfot exceeding ten acres at any one point,
to be used by them for all necessary purposes of said road, or to be
disposed of by them when it shall be deemed proper.
Storage allowed.  2. Be it fither enacted, That it shall be lawful for the said pre-
sident and directors to charge for the storage of produce, merchan-
dize and other articles, at such warehouses as they may find it ne-
cessary to construct, rates not exceeding the ordinary warehouse
dues paid in the borough of Norfolk.
Ion ty , rinjr.  3. Be it further enacted, That if any person or persons shall

od.        wilfully, by any means whatsoever, injure, impair or destroy any part
of the rail-road, or any of the necessary works, buildings, machines,
wagons, vehicles or carriages, he or they shall forfeit and pay to the
lowrecoverable. company, three times the actual damages so sustained, to be sued
for and recovered with full costs, before any tribunal having cogni-
zance of the same, by action of debt, in the name and for the use
of said company.
PNnishmentto,  4. Be it funther enacted, That if any person or persons shall wil-
to ibloltruetons fully and maliciously remove or disturb any of the company's con-
structions, or place designedly and with evil intent, any obstruction
on the line of their rail-road, so as to jeopardize the safety and endan-
ger the lives of persons travelling the same, such pe -son or persons so
offending, shall he deemed to be guilty of a high crime and misde-
meanor, and if such person or persons be free, lie, she or they shall be
adjudged on conviction, to be imprisoned in the common jail or peni-
tentiary house for a term not less than two nor more than five years;
and if such person or persons be a slave or slaves, he, she or they
shall suffer death without benefit of clergy.
Remedies for tres-  5. Be it further enacted, That nothing herein contained shall

ing any other penalties provided by law, and their act of incorpora-
tion, for trespasses on their property.
Power to enter  6. Be it further enacted, That so much of the eighth section of

oke rail-road company, as inhibits the said company from invading
the yard, garden, curtilage or orchard of any person without his or
her consent, shall not be deemed to extend to lots and tenements
situated within the town of Suffolk, and the said company shall
have full power and authority to enter upon and occupy for their
rail-road as much ground as may be necessary for the same within
