It happonid, however, that the widow mar- ried again, and died in this state, and although the children have nil since removed to Kentucky, according to the appointment of their flather, yet the condition stated in the will, not having been lite- rally performed by the removal of their mother to that state, the sale of the Virginia lands cannot, according to the terms of the will, be made, and they having petitioned that the acting executor may be authorized by law, to make such sale and fulfil the manifest design of. the testator : couny court or 1. Ruflfiu refuse or neglect to give such bond, with such security, within three months after the passage of this act, the said court shall appoint three or more commissioners, and decree them to make sale of the said land, on the said terms, and account for the bonds, or money, as tile case may he, arising from the sale, as in cases of lecrees for the sale of the real estate of persons dying in testate. Dixon, late of the said county, deceased, to cause the land and slaves allotted to his widow, Maria Dixon, a lunatic, and also her share in the surplus of his perishable estato, and the money and ef- fects of tile said Maria Dixon, in the hands of her committee, to be divided amongst the representatives of the said Turner Dixon, and the children of' the said Maria Dixon, in like manner as if she were Proviso. dead and intestate, except as hereinafter excepted: And provided also, That nothing in this act contained, shall, in any degree, im- pair or affect the title of the said Maria Dixon, to the said land, slaves, money and eflects, or her right to recover tile same, if at any time hereafter she shall become of sane mind. vertullin, to 2.
