they were intended or directed under the authority aforesaid, in the
same manner, and under the same rules and reghlations, as if said
clause had not been hereby repealed.

CIuAP. 20.-An ACT to establish 'a town at the Orkney or Yellow springs, in
the county of Shenandoah.

Preamble.    Whereas it is represented to the general assembly, by sundry ci.
tizens of the countieff of Shenandoah, Rockingham, and Hardy, that
the Orkney springs, commonlycalled the Yellow s prings, in the
rounty of Shenandoah, are held-In high repute for their medicinal.
qualities ; that the late' Peter Higgans, (the former proprietor,) in
his life time, at the request of many citizens of the aforesaid coun-
ties, for their accommodation, and the convenienceof those using
the waters, caused a public square, with lots, streets and alleys, to
be regularly laid off, which his executors have since found it neces-
sary Ibr the accommodation and convenience aforesaid, to enlarge
and improve, accordintg to a certain plan now exhibited ; and pray-
ing that the general assembly will establish the same as a town,
under certain reserved rights, as to the land, and with certain per-
sons trustees thereof, having the usual powers as to the making of
by-laws, and appointment of certain officers for police purposes:
TJerefore,
Van furenville  1 Be it enacted, That not exceeding twenty acres of land, the
ostablishod.  property of the heirs of Peter Higgans and others, at the Orkney
or Yellow springs, in the county of Shenandoah, as the same has
heretofore been laid off into lots, streets and alleys, and as the same
may be hereafter further laid off and extended into lots, streets and
alleys, shall be, and the same is hereby established a town by the
Trustee.   name of Van Burenville; ;4nd that Andrew Byrd, John Bassey,
Adam Barb, James M. H. Betilo, Reuben Walton, Samuel Walton,
Joseph Funk, Abraham Byrd, John Bowman, Jacob D. William-
son and Jacob Cootes, be, and they are hereby appointed trustees
thereof; who shall, as also their successors, before they enter'upon
the duties of their appointmept, respectively take an oath, or make
solemn affirmation, before some justice of the peace for either of
the counties of Shenandoah, Rockingham or Hardy, to execute the
same faithfully.and impartially, according to the best of their skill
and judgment;  ,t majority of whom may form a qvorum to proceed
to business under the authority of this act.
Powerto make by-  2. Be it further enacted, That the trustees of said town, or a
laws.       majority of them, shall be, and they are hereby empowered to make
such by-laws and oidinances for the regulating the police thereof,
and for the regular building of houses therein, as to them shall
seem best, and the same to amenid, enforce or repeal.: Provided
