(Passed February 2eth, 18t2.) Whereas John Somerville, deceased, late of Mecklenburg county, 'rtea,,,Ill. devised his real estate, consisting of one large and valuable tract of land, to his five youngest sons, who are infants, and to whom also he bequeathed his slaves, empowering his executor to sell, for tile payment of his debts, (which amount to a considerable sum,) any part of the estate, real or personal : and it is believed by the executor that a division of the land, and sale of a part thereof to pay the debts, would greatly diminislh the relative value of every part thereof, and thus seriously injure the interests of the devisees, while a sale of slaves for the purpose aforesaid, would so far lessen the profits of their estate as to deprive them to a great degree of the benetits of education ; and consequently, that a sale of all the land aforesaid in one tract, is the most effectual mode of protecting and preserving the rights and interests of the said infint devisees : 1.
