devolved upon them by this act, shall be, and they are hereby
authorised and empowered to make sale of the property, real and
personal, now held by them uinder the deed aforeaid, nod convey
the same. to the purchaser or purchasers thereof, and to vest so
much of the proceeds of such sale or sales, not less than five hun.
dred dollars, as they may deem best f'or the interests of those for
whose benefit the said trust was created, in other lands, either in.
this State, or any other of the United States, to be held by them,
subject to the provisions of the said trust deed, in the same man-
ner as the proper'ty is now hieli, which is hereby authorised to be
sold ; and time residue (if the monies ar,.sini frm tlme sales hereby
authorised, shall be appropria ted by the siai d trum stees in supplying
the present or accruing wants t' the fnmily of the said Samuel
Johns. The bond herein before mentioned, shall not become vuid
upon the first recovery, but may be put in suit, and prosecuted
from time to time, by and at the costs of any person or persons
injured by a breach thereof, until the whole penalty be recovered
thereupon.

Preamble.      Whereas, it is repre'sented i ile Get,ral Asenibly by Frances
B. Irby, the widow, William 1i by, an adult son, Villiam B. h by,
guardian of Edmund , John, Benjamiii, lichard, and Eliza Frances
Irby, the inf'ant childreno, and L,'w.,llin Jones, and William R.
Johnson, adminiAtrators of Eldihund Irby, late of' the county of
Nottoway, deceastlill, that lie departed this lifle intestate in' the
month of August last, owing debts to tile amnnunt of' fifty.one
thousand six hundred and nimty steven dollars eihteen cents,
which have come to tie knowl edge it' his adminmistrators, or whi ic,
the sum of' forty-five thousand one hundred and ninety-nine dol-
lars nimety-one ceois is due by specialties binding his heirs ; that
the decedent owned tlhree tracts of land, one lying on Banister
river, in the county of llalilaX, containing filhlen hundred and
ninety-five acres, estimated to be worth thirty five thousand 41ol.
lars: for the purchase ,money of' this tract, there is still due
twelve thousand seven hundred and thirty dollars sixteen cents,
for eight thousand nine hundred and tlirty nine dollars eleven
cents or' which, one-halt' or the original tm'act may be sold, as the
vendoor has not parted with the tille; one lying in the county of
Lunenburg, containing ium'teen hundred and eighty acres, with
the mill thereon, estimated to be worthl eight thtiusand dollars;
and the other lying iii the couly tf Nottoway, containing, four-
teen hundred and sixty lim'ee acres, estimated to be worth 'fifteen
thousand dollars, o whiich tihe decedent lived until his death, and
his widow and children now live; that the whole personal estate
of the decedent, including one hundred anti sixteen slaves, has
been appraised by appraisers appointed by the county court of
Nottoway, to thirty.three thousand five hundred and forty.five
dollars andi fifty-five cents; that tIhe whole amoumt or' debts due
to the decedent at the time of his dh.alh, do nut exceed three
thousand dollars, and probably ilo not anmount to tht sum, a large
