CHAPTER 153.-An act concerning William Ashby.
(Passed February 28th, 1828.)
Preamble.      Whereas, it is represented to the General Assembly by Williamq
Ashby, of the county of Culpeper, that in the'year eighteen hun-
dred and seventeen, a decree of' the superior court of chancery,
for the Richmond district, was obtained in favor of the Common-
wealth, against a certain William Ball, deceased, by virtue of
which a certain John W. Green, as commissioner.of the said court,
and as agent for the Commonwealth, advertised for sale certain
negroes, as tie property of said Ball, to satisfy the said decree;
when the said negroes, believing that they were entitled to their
freedom, petitioned the county court of Culpeper to be allowed to
sue, in forma pauperis, for the establishment of their freedom,
which petition being grailted, a suit was instituted by them ; that
the saul Green refused to enter into bond with satislactory secu-
rity, as the law directs, for the forthcoming of said negroes, and
the sheriff of said county was ordered to take then into his pos-
session, and them safely keep until the termination of their suit;
that the said Ashiby being then a deputy sherilr in the county of
Culpeper, it devolved upon him to take possession of and retain
saidt negroes, until a decision of the suit could be had ; that in
April, eighteen hundred and twenty-seven, the suit was finally
determined in the court of Appeals in their favor, when they were
set at liberty; that during nine years and six months, (the time
which. elapsed fr-ou the commencement to the termination of the
suit,) the said Ashby incurred every expense for the maintenance
and clothing of the said negroes, and believing that the Common-
wealth was bound for the payment of his account for their sup-
port, lie applied to the Auditor for payinent, who refused to pay,
because there was no law which authorised the payment of such
claims:
Auditoreuthoris.  I, lie it heireforie enaeied, That the Auditor of Public Ac-
ed to settle with  counts be, and he is hereby authorised and required to settle. with
William Ashby
tforvalue ofertain the said William Ashby, upon such terns and principles, as may
negroes.     be by him considered just and equitable; taking into considera-
tion'the value of the labour performed by the said negroes, for the
said Ashby, during the time they were in his possession as afore-
said, and making a fair estimate of the probable expense necessa-
rily incurred by him, in maintaining and clothing them during the
saine time. together with such other expense as it may appear to
the Auditor the said Ashby may have reasonably and necessarily
incurred in the discharge of his duty : And it; upon such settle-
ment, a balance be found to be due to the said Ashby, to issue a
warrant on the treasury in his favor for the same, to be paid to
him, or to his representative, out of any money therein, not other-
Proviso.     wise appropriated: Provided, That nothing in this act shall be
so construed, as to authorise the payment of interest on iy ba-
lance which may be found due.
Commencement.  2. This act shall be in force from its passage.
