at the term when they shall lay their county levy, or at the term
when they shall have been summoned as afore.iaid, although a
majority of the acting justices be not present, shall be authorised
to hear and decide oil the said application, in the same. manner
as if a majority of the acting justices were present : and, until
application shall be made as aforesaid, or until twelve months
have expired from the passage of this act, the said Swan Hain-
bleton and Sarah his wife shall be and they are hereby permitted
to remain as free persons within this commonwealth, and to have

of color possess and enjoy within the same ; any law to the con.

Whereas Reuben Howard, late of the county-of Hlanover, de- PreamUle'.
ceased, did, by his last will and testament, direct that all his
negroes be cmancipttted, whenever the same may be lawfully
done, did devise to them his land and other property, and direct
that his executors take what course with the said negroes they
should think just and proper; and whereab John Bell, the only
acting executor of the said Howard, and trustee under his will,
has petitioned the legislature to pass a law authorising' him to
make sale of the said land, and remove the said negroes out of
this commonwealth
