four freeholders subject to such levy, to award a siliersedeas to
ie order of court whereby such levy was laid,-it, upon the in-
qpection of a copy of such order, it shall appear that the levy
has been laid contrary to law; and, at the same time, it shall be
lawful to award a certiorari to cause the record of such levy to
be certified into the superior court of law having jurisdiction
over such county. When such record shall be so certified, the
superior court shall proceed, without delay, to reverse or affirm
the order laying the said levy, as to them may- seem right.
Whenever such supersedeas and ceriorari shall be granted, it
shall be lawful for the court of the county, without waiting the
final decision thereof, at any time, to rescind the order laying the
said levy, and to proceed forthwith again to lay the countyvM levy
according to law, and to canse the same to be collected in the
manner herein before provided.-In, like manner, if (le order
iforesaid be reversed by the superior court, the coulv court may
proceed, at any time afterwards, to lay tie levy acco ding to law.
In all cases, in which any county levy shall lie laid after the June
tern, of such county court, the sherill' or collector shall be allowed
five months, from the time of such levy, for collecting and tic-
counting therefor. If any sherill'or collector shall, at any time,
collectany money levied as aforesaid, and Such levy shnli be af-
terwards rescinded or reversed in the manner aforesaid. such
sherillfor collector shall fmrthwith return the mmicy, so collected,
to the person or per'sons From whom it shall have been received ;
and, in failure the'reof, he and his securities, his and their execu-
tors and administrators, shall be lialile to the same recovery and
damages, as is providel in case of his failurve to pay other money
due from himt as collector of his county levies.
Cimmeneetnent. § 15. This act shall commence and [6e in flarce fron and after
the first day of January eighteen hundred and twenty ; except so
much thereof as a.uthorizes the judges of the superior courts of law
to isue a stpt rsedeas and certior-ai to correct all er'oneotus
county levy, and hs relates to the power of the county courts,
and the duty oflthe sheritror collector consequent thereon, which
shall commence and le in force front and after the passing
thereof.
