?. And be it further enacted by the authority u6redaid, That
if any person or persons driving or riding in any  #-t  waggon or
other carriage, or riding, leading or driing any tdig sul ject to
toll by this act, shall pass through any gate, bars or fence, or
shall pass through any toll gate under any pretended exemption
or privilege to which he or she is not entitled, or to do any
thing in- their passage with intent to lessen or evade the tolls
hereby granted, he or she so offending shall forfeit and pny the
sum of five dollars (if a free person) to the use of the company,
to be recovered With costs as other penalties are by law'recover.
able, and if a slave to be punished wizh stripes not exceeding
fifteen lashes, upon conviction before a justice of the peace.
8. And be it further enacted by the authority aforesaid, That
all persons riding on horse back, or drawing any cart, waggon,
carriage or other thing along the said road, in passing any other
thing, uhall keep to the right in their pausing direction, and any
person offeiding herein, being a free person, shall be fined
In a sum not exceeding five dollars, to the use of the party hi.
jured, to be recovered with costs in the same manner as other
penalties are by law recoverable; and if the offender be a slave
to be punished with stripes, net exceeding fifteen, upon con-
viction before a justice of the peace for said county of
Fairfax.
9. And be it further enacted by the authority aforesaid, That
the president and directors shall cause a table of' the tolls paya-
ble for the use of said road to be constantly kept stuck up at
their toll gates, to be shewn to any person demanding the same.

Commencement   10. This act shall commence and be in force from and after the
passing thereof

Preamble.     7THEREAS it has been represented to this present General
V       Assembly, That a certain free man of colour by the name
of Frank, hath lately departed this' life, within the common-
wealth, leaving in bondage a widow, named Patience, and three
children, Philemon, Elizabeth and Henry, whom the said Frank
by his meritorious industry, purchased in his lifetime, but fail..
ed to emancipate, and asking the aid of the legislature in obtain-
ing their freedom:

Proviso. 

1. Be it enacted by the General Assembly, That the aforesaid
Patience, widow of the said Frank andithe aforesaid Philemon,
Elizabeth and Henry his children, henceforth shall be entitled to
all the rights and privileges of freedom, as much so as if they had
never been in slavery-, Provided always, that this act s.ill not be
construed to affect the claim of any person or persons whatsoever,
against the estate of which the said Frank died seized and posses-
sed.

Commencement. 2. This act shall commence and be in force from the passing
thereof.
