AN   ACT to amend the caption and first section of an Act rejating
to Forfeitures in certain cases of Bail Bonds and 1?ecognizances, in
cases of Mlisdemeanor, approved Dec. Oth 1861.
SErION 1. lBe il enacied by the Legislature of the State of T7zas, That the cap-
tion of the above named Act he and thc same is hereby amended so as hereafter
to read as follows, to-wit: An Act relating to forfeitures In certain cases of
ball bonds and recounizances In cases of felonies and misdemeanors,
Szc. 2. That t' first section of the above entitled Act shall hereafter reaud as
follows : That during the contiuance of the existing war between the Confud-
erate States of America and the United States, no forfeitures of any ball bond
or recognizance, executed or entered into, by any defendant or surety for a
defendant, witness or surety for it witness, In any case of misdemeanor or felony,
shall be taken or entered by Pny court In this State, against such defendant or
surety for defendant, witneoss or surety for witness, while such defendant or
witness shall be in the military or naval service of the Confederate States of
America or of this State; not shall any such forfeiture be taken or entered
against any such surety of a defendant or witness, while such surety shall b,, in
such service.
Snc. 3. This Act shall take effect and be In force from and after it passa 'e,
and shall cease to be of force or effect froin and after the establi.h, ment o peace
between the Confederate States and the United States.

CIIAPTER XVII.
AN   A OT to amend the first section of  An Act to reqIlate proceed-
ings in the District Courts, approved May 13th, 18413.
SgcTioN 1. Be it enacted by the Legislature of the &it of T e,.1, That the first
section of an Act entitled An Act to regulate proceedings in . istrict Courts,
approved May 13th, 1846, be so amended as to read as follows: No person who
is an Inhabitant of this State shall be sued out of the County where he has his
domicll, except in the following cases, vlz : First, In case of inarried women,
who must be sue(' In the county where her husband has his donilcil; Second, In
case the defendant is a transient person, in which case he may Le sued In what-
ever county he may be found; Third, in cases where there may be two or more
defendants residing in difieren  counties, In which cases the plaintiff may Institute
suit In any county where any of such defendants may reside ; Fourth, in cases
where a person has contracted to pirform an obligation in any particular
county, In which case suit may be Instituted in that county, or where the defen-
dant has his dounicil ; Fifth, in cases of executors, administrators or guardians
of an estate, or trustees, who must be sued in the county in which the estate Is
administered; Sixth, in cases of fraud and also In cases of defalcation of public
officers,i In which cases suit may be instituted in the county where the fraud
was committed, or where the defalcation occurred, or where the defendant has
his domleil; Seventh, where the defeulant has committed some crime, or offence,
or trespass, for which a civil action in damages may be commenced, in which
cases, suit may be Instituted In the county where the crime or ofllnce or trespass
was committed, or in the county where the defendant has his domiioll
Eighth, in cases where the suit Is for a blave, animal, or other movable property,
in which cases suit may be Instituted in whatever county such property may Ie
found, or where the defendant resides; Ninth, In cases where the delendant has
Inherited an estate, concerning which suit is commenced, In which case suit
may be instituted in the county where'the estate principally lies; Tenth, in cases
for the foreclosure of mortgages or lien, in which cases suit may be instituted
in the county where the mortgaged property or property subject to lien, or any
