Texas, approved 28th August, 1856.
ARTICLE 1.   &s it enacted by tde Legislature of the State
of lexasw, That the following Chapter  f and Articles of the act
above recited, commonly known as the Penal Code, be, and
they are hereby so amended as that the same shall hereafter
respectirely read as follows-that is to say:

General Provisions Relating to-the whole Code.
TITLE 1.
The general objects of the Code-The principles on which it is
founded, -and rules for the intetpr)rdation of Penal Laws.
Article 4 shall hereafter read thus :
The principles of the common law shall be the rule of con-
strnction, when not in conflict with the Penal Code or Code of
Criminal Procedure, or with some other written statute of the
State.
Article 9 shall hereafter read as follows
This Code, and every other law upon the subject of crime,
which may be enacted, shall be construe4 acording to the
plain import of the language in which it is written, without
regard to the distinction usually made between the construc-
tion of penal laws and laws upon other subjects, and no per-
son shhll be punished for an offence which is Rot made penal
by the plain import of the words of a law.
TITLE 2.
Of Punishments O General.
Article 9.4 shall hereafter read as follows :
When the penalty affixed to the commission of an .ffenc
is deprivation of )olitical rights, such rights are intended to
include the rights of holding office., of serving on juries, and
of suffrage.
