a license tax for such privilege.
'f  .iou 1. Bo it onated by the L giulaturs of the state
Tom,. That any person or firm hereafter wishing to engage in
the business occpatio 1 of selling Spirituous, vinous or other
intoxicating liquors in quantities less than a quart, shall have
the privilege of Ooing so, upon his, her or their application in
writing to the county court of the county where he, she or they
shall reside, stating the house or place where he, she or they
propose to carry on such business and occupation and for what

Smo. 2. That upon the presentation of the written applica-
tion of the party or parties to the coutity coiirt, it shall then be
the duty of said court to order the Clerk thereof to issue to the
applicant a license, authorizing him, her or them to retail spir.
ituous, vinous or other intoxicating liquors in quantities less
than one quart at the house or place specified in said written
application, and for the length of time applied for upon condi-
tions hereinalter prescribed.
Smc. 8. That before the Clerk of the coutity court shall
issue to thp applicant a license to retail spirituous, vinous and
other liquors in quantities less than a quart, he, she or they
shall make and deliver to the county Treasurer, a bond paya.
bib to the Chief Justice of said county, with two or more good
and sufficient sureties to be approved by said Treasurer, in the
sum of oea thousand dollars, conditioned that the applicant
and those aotirg or attending to said business for him, shall
keep ai ordorly house or place for the retail of spirituous liq-
uors,, and that he will not permit a sale of spirituous liquors to
be made at his house or place to minors under the age of-sixteen
years, or students of any institution of learning, or to negro
slaves without the written permission of the master, mistress or
overseer of said slave, and that he will not permit any games to
be played at the house or )lace whetl or licensed or not, which
bond upon being approved by the said county Treasurer, shall
be filed in his office, as an obligation belonging to his county.
Sac. 4. That when the party or firm shall have executed the
bond with security as prescribed in the preceding section of
this Act and shall have paid into the county Treasury of tko
county a license tax, at the rate of two hundred and fifty dol.
