for the use and benefit of the County for which the said site has
been selected and permanently established..
SEC. 2. Be it further enacted, T at the value of the land
so assessed and condemned, shall be collected from the sales of
the lots laid off and sold in the county site town ; and it iA hereby
made the duty of the sheriff of the county of Milam, to collect
the same, anddeliver it over to the chief justice, who shall pay
the amount so delivered, to the owner or owners thereaf, when.
ever he she, or they, shall come forward and make a fee srmple
title to the chief justice and hi successors in office, for the amount
of land so assessed and condemned for public use.
Src. 3. Be itfurther enacted, That this act shall take effect
and be in force from and after its passane.

AN ACT
Supplementary and Amendatory of certain Acts therein named.
Src. 1. Be it enacted by the Senate and Ihouse of Repre-
sentative.q of the Republic of Te.xas, in Congress assembled,
That whenever any vacancy shall occur in the office of associate
justice of'the county court, either from the expiration of his of-
cial term, resignation, or othervise, it shall be the duty of the
several justices of the peace of said county, upon notification
from the chief justice, to assemble, and elect from among their
own body, an associate or associate justices, to supply said
vacancy.
Suc. 2. Be it further enacted, That in all cases in which
the chief justice of any count in this republic shall be interested,
absent, or unable to perform his duties, the associate justices of
the county court shall be authorized and empowered to act in
his stead.
SEC. 3. Be -( further enacted, That in all pr6secutions of
slaves betbre the county court, under the (Act for the Punish-
ment of Crimes and Misdemeanors committed by slaves and free
persons of color, approved December 14tb, 1837, the chief
