AN ACT
Concerning Uonveyances.
Stc. 1. Be it enacted by the Senate and House of Repre.
sentatives of the Republic of Texas in Congress assembled,
That no estate of inheritance or freehold, or for a term of more
than five years, in lands and tenements, shall be conveyed from
one to another, unless the conveyance be declared by writing,
sealed and delivered  and any instrument to which the person
-making the same shall nflix a scroll, by way of seal, shall be ad-
jadged and holden to be of the same force and obligation as if it
were actually sealed: rovided the person making the same
shall, in the body of tie instrument, recognize sucl) scroll as
having been alfixed by way of seal; nor shall such conveyance
!)e good against a purchaser for valuable consideration not
ing notice thereof; nor any creditor, unless the same writimt ._
acksowledged by the party or parties who shall have sealed ad
delivered it, or proved by two witnesses to be his, her, or their
act, before the County Court of the coutity in which the land
conveyed, or some'part thereof, lioth  or in the manner heroinif-
ter directed, and be lodged with the dlerk of the County Court to
be recorded.
Src. 2. Be itkfrther enacted, That no covenant or agree.
ment made in consideration of marriage shall be good against a
purchaser for a valuable consideration- notghving notice thereof,
or any creditor, unless the same covenant or agreement be ac-
knowledged by the party to be bound thereby, or proved by two
witnesses to be his, her, or their act; if lana be charged before
the court of the bounty in which the land, or part thereof, lieth;
or if personal 6state only be settled, or covenanted, or agreed to
